Financify operates an online lending platform that connects borrowers with investors. We are not a bank and do not make loans or credit decisions.

3. Borrower Terms

• By applying for a loan, you authorize us to obtain your credit report and verify your information.
• Loan approvals are subject to credit review and investor interest.
• Interest rates vary based on creditworthiness and range from 5.99% to 35.99% APR.
• Late payments may be subject to fees and reported to credit bureaus.

4. Investor Terms

• Investing involves risk, including possible loss of principal.
• Past performance is not indicative of future results.
• Investors must meet accreditation requirements for certain offerings.
• Investments are not FDIC insured and are not guaranteed.

5. User Accounts

When you create an account, you must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account.

6. Fees

• Borrowers may pay an origination fee (0.5-5% of loan amount).
• Investors pay a 1% annual servicing fee on outstanding balances.
• There are no prepayment penalties for borrowers.

7. Intellectual Property

The service and its original content, features, and functionality are owned by Financify and are protected by copyright, trademark, and other intellectual property laws.

8. Prohibited Uses

You may not use our service:

• For any unlawful purpose
• To submit false or misleading information
• To interfere with the service's operation
• To attempt to gain unauthorized access

9. Limitation of Liability

Financify shall not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of or inability to use the service.

10. Indemnification

You agree to defend, indemnify and hold harmless Financify from any claims, damages, liabilities, and expenses arising from your use of the service or violation of these Terms.

11. Governing Law

These Terms shall be governed by the laws of the State of California without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the service after changes constitutes acceptance.
